STANDARD PRODUCT WARRANTY

Limited Lifetime Warranty (Warranty 12)

Cooper Environmental Services (CES) warrants to the original end user purchaser (“original purchaser”) of the product listed on the “CES PRODUCT LIST” that the product will be free from defects in materials and workmanship for the lifetime of the product except for the X-ray Tube. As used herein, “lifetime of the product” is defined as a period ending nine (9) months after product is built or provided to the customer for independent operation. The limited lifetime warranty for the X-ray Tube is an extension of the manufactures prorata warranty, which states they will either: 1) refund the prorata portion of the purchase price, 2) repair the X-ray Tube, at no cost to the Customer, upon return of failed X-ray Tube to manufacture, or 3) apply a prorata credit on a replacement order for a new X-ray tube. This limited lifetime warranty only applies to the original purchaser and is non-transferable. In the event of a warranty claim under the limited lifetime warranty, the purchaser must provide satisfactory evidence of the date of purchase from Cooper Environmental Services (CES) or an authorized Cooper Environmental Services (CES) distributor and that it is the original purchaser. The following items are not covered by this warranty:

If the product proves defective during the applicable warranty period, Cooper Environmental Services (CES), at its option, either will repair the defective product without charge for parts and labor, or will provide a replacement of an equivalent product (as determined by Cooper Environmental Services (CES)) in exchange for the defective product. Parts, modules and replacement products used by Cooper Environmental Services (CES) for warranty work may be new or reconditioned to like new performance. All warranty replaced parts, modules and products must be returned to Cooper Environmental Services (CES) with a RETURN MATERIALS AUTHORIZATION NUMBER (RMA) issued by an authorized representative employed by Cooper Environmental Services (CES). The completed and signed RMA shall describe in writing all defects being claimed. The RMA will also serve, if the warranty claim is upheld as the signed release acknowledgment relinquishing the RMA warranty part or parts as the property of Cooper Environmental Services (CES).

As used hereafter, “CUSTOMER” refers to the person or entity asserting rights under this warranty. In order to obtain service under this warranty, CUSTOMERS must notify Cooper Environmental Services (CES) in writing of said defect within 30 days of the failure and before the expiration of the applicable warranty period. CUSTOMERS shall make suitable arrangements for the performance of warranty service. CUSTOMERS shall be responsible for properly packaging and shipping the defective product to the Cooper Environmental Services (CES) service center, shipping charges prepaid and with a copy of proof of purchase by the original purchaser. CUSTOMERS shall be responsible for paying shipping charges, duties, taxes, and any other charges for products returned. CUSTOMERS shall also be responsible for any damages to returned products which may have occurred in shipment or that were not claimed in writing within the RMA document.

This warranty shall not apply to any defect, failure, or damage caused by accident, ordinary wear and tear of mechanical components, use outside of the product’s specifications, improper use or improper or inadequate maintenance and care. Cooper Environmental Services (CES) shall not be obligated to furnish service under this warranty a) to repair damage resulting from attempts by personnel other than a Cooper Environmental Services (CES) representatives to install, repair, or service the product; b) to repair damage resulting from improper use or connection to incompatible equipment or power sources; c) to repair any damage or malfunction caused by the use of non- Cooper Environmental Services (CES) identified supported supplies; or d) to service a product that has been modified or integrated with other products when the effect of such modification or integration increases the time or difficulty of serving the product: e) failure to provide conditioned electrical power with surge protection; f) where frequent power outages occur to provide UPS installed; g) failure to maintain enclosure or shelter roof penetrations; h) failure to maintain environmental conditions states (Merv 10 air quality at 20 0C +/- 20C; i) failure to conduct monthly evaluation and provide maintenance as needed to enclosure fan filter; j) to any instrument that has been operated by a person who has not been trained by an authorized representative for Cooper Environmental Services (CES); and k) to any instrument that has been serviced or maintained by an individual or individuals who have not been trained directly by an authorized service repair technician employed by Cooper Environmental Services (CES).

To sustain this warranty the CUSTOMER must conduct (by a CES factory trained service technician), document and report all RECOMMENDED MAINTENACE AND CALIBRATION tasks to Cooper Environmental Services (CES) confirming that all elements of the RECOMMENDED MAINTENACE AND CALIBRATION SCHEDULE in Xact Maintenance Manual have been accomplished. This report is to be returned to Cooper Environmental Services (CES) with in 45 days of the end of each calendar quarter.

THIS WARRANTY IS GIVEN BY Cooper Environmental Services (CES) WITH RESPECT TO THE PRODUCT IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, Cooper Environmental Services (CES) AND ITS VENDORS DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Cooper Environmental Services (CES) RESPONSIBILITY TO REPAIR OR REPLACE DEFECTIVE PRODUCTS IS THE SOLE AND EXCLUSTIVE REMEDY PROVIDED TO THE CUSTOMER FOR BREACH OF THIS WARRANTY. Cooper Environmental Services (CES) AND ITS VENDORS WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES IRRESPECTIVE OF WHETHER Cooper Environmental Services (CES) OR THE VENDOR HAS ADVANCE NOTICE OF THE POSSIBLITY OF SUCH DAMAGES.
